RE Virton is still in the game!
Last week, Belgian soccer club RE Virton filed two legal actions following the arbitration award confirming SK Lommel's license for the 2023-2024 season. It is asking the Brussels Court of First Instance to annul the award on the grounds that it is contrary to the rules of public policy (European competition law) and invites it - insofar as necessary - to refer the case to the CJEU for a preliminary ruling.
At the same time, RE Virton is requesting interim measures, asking the Brussels Court of First Instance to order the Belgian Football Federation and the Pro League to make the necessary adjustments so that RE Virton can be reinstated in the D1B division for the next season. This will enable the European Commission to carefully examine the complaint lodged by RE Virton at EU level and ensure that the illegal granting of a professional license to SK Lommel will not result in RE Virton's exclusion from the Belgian professional football market in favour of a club, SK Lommel, which has obtained its license only thanks to "foreign subsidies" in violation of various public policy provisions of EU legislation.

RE Virton est toujours dans la course !
La semaine dernière, le club de football belge RE Virton a introduit deux actions en justice à la suite de la sentence arbitrale confirmant la licence du SK Lommel pour la saison 2023-2024. Il demande au Tribunal de première instance de Bruxelles d'annuler la sentence au motif qu'elle est contraire à des règles d'ordre public (droit européen de la concurrence) et l'invite - pour autant que de besoin - à saisir la CJUE de questions préjudicielles.
En même temps, le RE Virton sollicite des mesures provisoires, en demandant au tribunal de première instance de Bruxelles d'ordonner à la Fédération belge de football et à la Pro League de procéder aux adaptations nécessaires pour que RE Virton soit repris dans la division D1B pour la prochaine saison. Cela permettra à la Commission européenne d'examiner attentivement la plainte déposée par RE Virton au niveau européen, et de s'assurer que l'octroi illégal d'une licence professionnelle au SK Lommel n'entraînera pas l'exclusion de RE Virton du marché du football professionnel belge au profit d'un club, le SK Lommel, qui n'a obtenu sa licence que grâce à des « subventions étrangères » en violation de diverses dispositions d'ordre public de la législation de l'UE.
